TERMS AND CONDITIONS OF SERVICE
Ripton Community Broadband – Fixed Wireless Internet Service
Effective Date: August 18, 2025
These Terms and Conditions (“Terms”) govern the use of internet services (“Services”) provided by RIPTON COMMUNITY BROADBAND INC. (“Company”, “we”, “us”, or “our”). By using our Services, you (“Customer”, “you”, or “your”) agree to abide by these Terms.
Service Overview
Our fixed wireless internet service is delivered via radio signal from a nearby access point to a receiver installed at your premises. Service availability and speeds are subject to signal strength, weather, terrain, and other environmental factors.
Installation and Equipment
Installation: You agree to allow our technicians access to install and configure the required equipment at your premises.
Equipment Ownership: Unless otherwise specified, all equipment remains the property of Ripton Community Broadband. You must return it upon service termination.
Customer-Owned Equipment: Customers will not be able to use their own router or networking equipment; customers may only use equipment provided by Ripton Community Broadband.
Service Speeds and Performance
Speeds are advertised as “up to” and are not guaranteed.
Performance may vary due to factors outside our control (e.g., weather, line-of-sight obstruction, network congestion).
We do not guarantee uninterrupted or error-free service.
Acceptable Use Policy (AUP)
You agree not to use our Services to:
Engage in illegal activities or violate applicable laws.
Send spam or harmful software.
Interfere with the operation of our network or others’ use of the service.
We reserve the right to suspend or terminate service for violations of this AUP.
Billing and Payment
Billing Cycle: Service is billed monthly in advance unless otherwise agreed upon.
Payment Due Date: Payment is due on the date listed on your invoice.
Late Payments: A late fee may be assessed for payments not received within 15 days of the due date.
Nonpayment: If payment is not received, your service may be suspended or terminated.
Data Caps and Overage Fees
Some service plans may include data usage caps. If you exceed your monthly data allowance:
Overage charges may apply as specified in your service plan.
Speeds may be reduced during periods of network congestion.
Unlimited plans may be subject to a fair use policy.
Add-On Services and VoIP Disclaimer
Any additional services, such as Voice over IP (VoIP), video streaming, or managed Wi-Fi, are provided as-is. VoIP service relies on internet connectivity and may not function during outages or power failures. You are responsible for maintaining alternative means of communication, including access to 911 services.
Termination and Cancellation
You may cancel service at any time by providing 30 days’ notice.
We may terminate service for nonpayment, breach of these Terms, or network abuse.
Any unreturned equipment may result in additional charges.
Service Availability and Outages
We strive to provide reliable service but do not guarantee uptime. Planned maintenance or unforeseen outages may occur. In such cases, we will make reasonable efforts to restore service promptly.
Liability and Disclaimers
We are not liable for any indirect, incidental, or consequential damages arising from your use or inability to use the service.
Our maximum liability is limited to the amount paid for services during the previous month.

FCC Compliance
Ripton Community Broadband complies with applicable FCC rules, including the submission of Form 477 broadband availability data and adherence to the Open Internet rules (e.g., no blocking, throttling, or paid prioritization outside of disclosed policies).
Lifeline and ACP Participation
We support digital inclusion and may participate in government affordability programs such as:
Lifeline: A federal program offering discounted service to qualifying low-income households.
Affordable Connectivity Program (ACP): Provides eligible customers with discounts on internet service.
Program participation and eligibility are subject to federal and state requirements. Please visit FCC.gov or contact us to check current availability.
Changes to Terms
We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance.
